Rental Terms and Conditions of the Swiss Travel Fund (Reka) Cooperative* for Reka Holidays

1. Booking – how and where?

You can book via the internet reka.ch, by telephoning the Central Booking Office +41 31 329 66 99, by fax +41 31 329 66 01 or by e-mail ferien@ reka.ch. The rental agreement between the tenant and the Reka will be concluded upon the explicit and unconditional acceptance of the booking by the Reka, i.e. by confirmation sent by e-mail or by post. The tenant will receive the contract documents from the Reka together with the booking confirmation. The tenant must pay the processing fee and down payment according to sections 4 and 5 of the Standard Form Contract within 30 days.


 Holidays with flights

When an arrangement involving air transport is booked, it is imperative that travellers‘ names and dates of birth be given exactly as they appear in their travel documents (passport, identity card). Otherwise, you may possibly not be allowed to board your flight.


2. Prices

By making the booking, the tenant accepts the valid rental price published online by the Reka for the property booked. This price is definitively confirmed in the contract documents.


3. Extras

Extra costs, such as electricity and bed linen, are generally included in the rental price. Detailed information will be found in the price tables (Catalogue/ reka.ch). Other extra costs which are not included in the rental price are specified in the contract documents. As a rule you must bring your own kitchen and bath towels (exceptions are mentioned).


4. Processing  fee

A CHF 50.– processing fee is charged for the reservation. However, in the event of immediate payment of the whole amount on booking by credit card, Reka-Card or a voucher, the processing fee will be waived. (This also applies for bookings made via the internet or by telephone.)


5. Payment

A down payment (20% of the rental price, min. CHF 200.– and max CHF 500.–) must be paid within 30 days of the booking. The remaining balance of the rental price must be paid at the latest 42 prior to the start of the holiday. The rental price can be settled in whole or in part with Reka money (Reka cheques or Reka-Card) (see remarks on the contract documents). If bookings (Reka Holidays in Switzerland and abroad) are made less than 42 days before the start of the holiday, the entire invoiced amount including the processing fee must be paid when the booking confirmation and contract documents are received. The following cards are accepted for payment: Visa, Mastercard, American Express, Postfinance (for online bookings only), myOne and the Reka-Card with sufficient funds. For last-minute bookings made less than 10 days (Reka Holidays Switzerland and abroad) before the start of the holidays, immediate payment is mandatory by credit card, Reka-Card or vouchers. In this case the contract documents are sent to the tenant upon reception of the payment.  If  the down payment or the remaining balance are not paid on time, the Reka may, after allowing a period of grace, cancel the contract and charge the tenant for the processing fees and cancellation costs as set out in Section 13. For bookings of hotel offers like Universal Reisen or the holiday village Ravensburger Spieleland, a processing fee of CHF 50.– is payable within 10 days. The rental price must be settled at the latest 42 days before the start of the holiday.

 

6. Number of persons

The number of persons occupying Reka holiday homes must not exceed the number stated on the contract documents. Late registrations must be noti-   fied to the Reka no later than two weeks before the start of the holiday with the names of the persons travelling and their dates of birth. In case of over- occupation, the Reka may cancel the rental agreement. The price of the accommodation remains payable in full.


7. Pets

Dogs are allowed in selected holiday resorts and holiday homes (for an extra charge, see contract documents). These are indicated with a special logo. Dogs must be kept on a leash in the holiday resort. The tenant is liable for any damage caused by the dog. All damage must be reported as soon as possible, at the latest at the end of the leasing period when the flat is handed over.  Claims may also be made against the tenant for any damage discovered after handover of the property.


8. Tenant’s liability and complaints

The tenant agrees to treat the Reka holiday home and its contents with care. He/She must respect the house rules. If any defects are noticed when taking possession of the rented accommodation they must be reported immediately to the key holder/host. Otherwise the accommodation shall be deemed to have been handed over in perfect condition. Otherwise it is assumed that the accommodation is handed over in perfect condition. Shortcomings not rectified on the premises to the tenant’s satisfaction must be reported within 48 hours to the Reka’s central rental office in Bern (tel. +41 31 329 66 99, fax +41 31 329 66 01, ferien@reka.ch). Claims for a reduction and damages should be sent in writing within 7 days of leaving the Reka accommodation (to the Swiss Travel Fund (Reka) Cooperative, Reka Holidays, Neuengasse 15, 3001 Bern). If a claim for a reduction or damages has not been reported in writing to the Reka within 7 days of leaving the accommodation, your rights lapse and you lose any possible entitlement to make claims against the Reka. The tenant is liable for damage caused by him and his guests. All damage must be reported as quickly as possible, but no later than at the time when the accommodation is handed back. The tenant may still be held responsible for defects which come to light after the accommodation has been handed back. The final cleaning costs declared in the rental agreement apply to a normal final cleaning, i.e. the accommodation must be handed back by the tenant in a   clean condition at the end of the rental period. In addition the crockery must be washed, the dishwasher emptied and refuse disposed of. If the accommodation is unusually dirty, the tenant agrees to pay a higher cleaning charge.


9. Use of Reka swimming pools

a) Young persons under the age of 16 must be accompanied by an adult when they use the swimming pool. Non-swimmers are not allowed to use the pool on their own. Non-swimmers must be supervised at all times in the swimming pool. Responsibility for permanent supervision rests with the tenant or with the persons retained by him for this purpose. The Reka does not appoint a swimming supervisor.

b) The tenant specifically acknowledges and calls the attention of his family members of and other joint occupants of his rented accommodation to   the fact that there is no lifeguard at the pool to take emergency rescue measures or administer first aid. Guests therefore use the pool at their own risk.

c) The tenant must ensure that young persons under the age of 16 are super- vised by an adult and behave in a way that does not endanger themselves or other guests.

d) d) The tenant must ensure that his family members and other occupants of the rented accommodation use the swimming pool and the related structural extensions with due care and show consideration for the other pool users.

e) These swimming rules apply in all Reka holiday villages. Any other swimming pool rules must be strictly respected at all times. 


10. Reka’s liability

The Reka Holidays catalogues have been carefully prepared. However, mis- takes may occur and give rise to complaints. The Reka declines all liability wherever legally possible. This is the case in particular for slight negligence and possible consequential damage (e.g. spoiled holidays, holiday time which could not be used, feelings of frustration, loss of profits, etc.). This also applies for extra-contractual liability. Liability for auxiliary personnel is totally declined. For damage (other than personal injury) the maximum liability amount is limited to twice the rental cost paid.  For package arrangements which are covered by the provisions of the law on package tours, the Reka’s liability for damage (other than personal injury) is limited to double the rental price/travel cost per participant. Should international agreements or laws apply which further limit or exclude the liability of the Reka, the Reka will assume liability exclusively within the terms of these agreements and laws. The Reka may compensate for the insufficiency by offering equivalent alternative accommodation. If this is refused, any further claim for damages is ruled out.

Reka declines all liability for events caused by factors beyond its control such as epidemics/pandemics, blocked access roads, closed highways, higher  than  usual  noise  levels, electricity cuts, environmental disasters, sea pollution, political unrest, strikes, opening hours of tourist attractions or government measures  of any kind whatsoever. If such events occur, the tenant has no right to terminate the contract or claim a reduction of the rental price or compensation.

If a tenant falls ill during his/her stay or arrives ill, Reka is entitled to consult a doctor and, if the health of other tenants and staff is threatened, to refuse the tenant or send him/her home. In this case also the tenant is not entitled to contract termination, reduction in rent or compensation.


11. Price and service changes

The Reka reserves the right to change published descriptions and prices. When    the booking is made, the customer is informed of any price and service changes and these are confirmed when the contract documents are sent. Price and service changes may occur exceptionally after the  contract has been concluded, e.g. fare changes made by transport companies (including fuel supplements), recently introduced or increased state taxes or other charges (e.g. airport tax, landing charges, shipping taxes), currency fluctuations, price rises imposed by the government (e.g. value added tax). The customer will be informed immediately of these modifications.

 

12. Cancellations and modifications

All cancellations must be made in writing (by e-mail, post or fax). Reception date at the Reka offices is decisive (and not the postmark). For Saturdays, Sundays and public holidays, the following working day will be regarded as decisive.

For modifications in existing bookings, (except for changes in the number of persons), equivalent to a cancellation or a change of booking, the Reka adds the following cancellation fees (in addition to the processing fee) to the rental price :


Reka Holidays Switzerland

  • From the booking date up to 42 days prior to start of holiday, 20 % of the rental price (min. CHF 200.– and max. CHF 500.–)
  • 41 to 10 days before the start of the holiday, 50% of the rental price
  • 9 days to 3 days before the start of the holiday, 80% of the rental price
  • From 2 days before the start of the holiday until the day the holiday is due to start or ‘no show’ at the holiday destination and also in the event of early departure, 100% of the rental price.

Reka holidays abroad

  • From the booking date up to 42 days prior to start of holiday, 20 % of the rental price (min. CHF 200.– and max. CHF 500.–)
  • 41 to 10 days before the holiday start, 50 % of the rental price
  • 9 to 3 days before the holiday start, 80 % of the rental price
  • 2 days before the holiday start or cancellation on the day of the holiday   start or in the event of a no show at the holiday destination and in case of early  departure,  100 % of  the  rental price.
  • If a replacement tenant is found, only the cancellation fee corresponding to the down payment is charged (solely for the Reka Holiday Resort Golfo del Sole).
  • For bookings with Universal Reisen a fee of CHF 200.- for cancellations up to 45 days prior to arrival  is charged. Any later booking alterations and cancellations are subject to our partner’s cancellation terms and conditions. Re-booking and cancellation of transport and additional services are subject to our partner’s cancellation conditions from the booking date, i.e. cancellation fees of up to 100% are possible from the booking date. Advance payments will be taken into account regarding cancellation costs.


13. Cancellation costs, breakdown and repatriation   insurance

In order that the tenant be protected against financial loss in the event of a cancellation, breakdown or medically prescribed repatriation following a serious occurrence such as illness, death and accident, he or she has the possibility of taking out a travel insurance when the booking contract is concluded. For the insured benefits the details given in the Terms and Conditions of AXA Winterthur are alone valid. When travel insurance is taken out, payment falls due with the down payment (see Section 5). If this payment date is not respected, insurance cover for the booked travel shall lapse. Once your travel insurance has been taken out it cannot be cancelled.


14. Travel Guarantee

Reka is a participant in the Swiss tourism sector’s guarantee fund and thus guarantees the tenant the safeguard of the amount he/she has paid in connection with the booking of a package holiday as well as the return journey. Detailed information is supplied by the booking office or the garantiefonds.ch.


15. Entry requirements

For travel to Germany, Austria, the Netherlands, Belgium, Italy, France, Croatia and Spain, Swiss citizens need a valid identity card or passport (the same requirements apply for children who must have their own passport or identity card). Citizens of other countries should enquire about requirements at the embassy or consulate of the country of destination. Each traveller is personally responsible for compliance with the entry requirements.


Reka contracts shall be governed exclusively by Swiss law. The place of jurisdiction is Bern, Switzerland.
